Terms of Service

These Terms of Service (“Terms”) govern your access to and use of SparkAM(“the app”), developed by Patito(the “developer”). By downloading or using the app, you agree to these Terms. If you don’t agree, please don’t use the app.

The app

SparkAM runs locally on your device. Features and content may change over time; the developer may add, modify, or remove features without notice.

License

The developer grants you a limited, non-exclusive, non-transferable, revocable license to use SparkAM on iOS devices you own or control, for personal, non-commercial use. This license is subject to the Apple Media Services Terms and Conditions and these Terms. All rights not expressly granted are reserved.

Your content

Any content you create or import into SparkAM— quotes, notes, photos, and the like — remains yours. The app stores this content locally on your device. You are responsible for the content you import and for ensuring you have the right to use it. Don’t import content that infringes anyone else’s rights.

In-app purchases and subscriptions

SparkAMoffers optional in-app purchases delivered through Apple’s StoreKit. If you choose to purchase:

• The title, length, and price of any subscription or purchase are displayed in the app and on the App Store before you confirm the transaction.
• Payment is charged to your Apple ID at confirmation of purchase.
• Subscriptions auto-renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple ID will be charged for renewal within 24 hours prior to the end of the current period at the price disclosed at signup.
• You can manage or cancel your subscription at any time in your Apple ID Settings → Subscriptions. The developer cannot cancel a subscription on your behalf.
• Where applicable, any unused portion of a free trial is forfeited when you purchase a subscription.

Refund requests are handled by Apple in accordance with their refund policy. The developer cannot issue App Store refunds directly.

Acceptable use

You agree not to:

• Reverse engineer, decompile, or attempt to derive the source code of the app, except as permitted by law.
• Use the app to violate any law or any other person’s rights.
• Resell, sublicense, or distribute the app outside the App Store.

No warranties

The app is provided “as is” without warranties of any kind, either express or implied, including merchantability, fitness for a particular purpose, or non-infringement. The developer does not warrant that the app will be uninterrupted or error-free, or that alarms will fire under all conditions — for example, if your device is powered off, if the operating system blocks notifications, or if required permissions have been revoked.

Limitation of liability

To the maximum extent permitted by law, the developer is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the app. The developer’s total liability for any claim arising out of these Terms or the app will not exceed the amount you paid the developer for the app in the twelve months preceding the claim.

Changes to these Terms

The developer may update these Terms from time to time. Material changes will be reflected by an updated “Last updated” date at the top of this page. Continued use of the app after changes means you accept the updated Terms.

Privacy

Your use of the app is also governed by the SparkAM Privacy Policy.
