Terms of Service

These Terms of Service (“Terms”) govern your access to and use of SparkAM(“the app”), developed by Patito(the “developer”). By downloading or using the app, you agree to these Terms. If you don’t agree, please don’t use the app.
The app
Core app content is stored locally on your device. Some features, including purchases and subscription verification where offered, rely on Apple or other third-party services and may require an internet connection. Features and content may change over time; the developer may add, modify, or remove features without notice.
License
The developer grants you a limited, non-exclusive, non-transferable, revocable license to use SparkAMon iOS devices you own or control, for personal, non-commercial use. This license is subject to these Terms, the applicable App Store Usage Rules, and Apple’s Standard EULA. All rights not expressly granted are reserved.
Your content
Information or content you create or import into SparkAMremains yours. The app stores this content locally on your device unless its Privacy Policy says otherwise. You are responsible for what you enter or import and for ensuring you have the right to use it. Don’t use content that infringes anyone else’s rights.
In-app purchases and subscriptions
SparkAMoffers optional in-app purchases delivered through Apple’s StoreKit. If you choose to purchase:
- The title, length, and price of any subscription or purchase are displayed in the app and on the App Store before you confirm the transaction.
- Payment is charged to your Apple Account at confirmation of purchase.
- Subscriptions auto-renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple Account will be charged for renewal within 24 hours prior to the end of the current period at the price disclosed at signup.
- You can manage or cancel your subscription at any time in your Apple Account Settings → Subscriptions. The developer cannot cancel a subscription on your behalf.
- Canceling stops future renewals. Unless Apple states otherwise, you will retain access through the end of the period you already paid for.
- Where applicable, any unused portion of a free trial is forfeited when you purchase a subscription.
Refund requests are handled by Apple in accordance with their refund policy. The developer cannot issue App Store refunds directly.
Acceptable use
You agree not to:
- Reverse engineer, decompile, or attempt to derive the source code of the app, except as permitted by law.
- Use the app to violate any law or any other person’s rights.
- Resell, sublicense, or distribute the app outside the App Store.
No warranties
The app is provided “as is” without warranties of any kind, either express or implied, including merchantability, fitness for a particular purpose, or non-infringement. The developer does not warrant that the app will be uninterrupted, error-free, or available under all conditions, including when your device is offline, powered off, restricted by the operating system, or unable to reach a required third-party service.
Limitation of liability
To the maximum extent permitted by law, the developer is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the app. The developer’s total liability for any claim arising out of these Terms or the app will not exceed the amount you paid the developer for the app in the twelve months preceding the claim.
Changes to these Terms
The developer may update these Terms from time to time. Material changes will be reflected by an updated “Last updated” date at the top of this page. Continued use of the app after changes means you accept the updated Terms.
Privacy
Your use of the app is also governed by the SparkAM Privacy Policy.
